1. Who we are
These Terms of Service govern the website and services provided by lomzyn-studio, Frednowy 54, 14-200 Iława, Poland. Email: contact@lomzyn-studio.online. Phone: +48 696 266 461.
2. Acceptance
By using our website or ordering our services you agree to these Terms. If you do not agree, please do not use our website or services.
3. Services
We provide web development, UI/UX design and related digital services. The scope, timeline and price of each project are set out in a written proposal or order confirmation, which forms part of the contract together with these Terms.
4. Formation of contract
A contract is concluded when you accept our proposal in writing (including by email) and we confirm acceptance. Information on our website is an invitation to enquire, not a binding offer.
5. Prices and payment
Prices are shown in the currency stated in the proposal. For consumers, prices include applicable VAT. Unless agreed otherwise, a 50% deposit is due before work begins and the balance upon delivery. Invoices are payable within 14 days.
6. Client obligations
You agree to provide content, feedback and access needed to complete the project on time, and confirm that any materials you supply do not infringe third-party rights.
7. Intellectual property
Upon full payment, the economic rights to the final deliverables transfer to you. We retain rights to pre-existing tools, code libraries and know-how, and may display the completed work in our portfolio unless you object in writing.
8. Consumer rights
If you are a consumer in the EU or UK, you have statutory rights that these Terms do not limit, including the 14-day right of withdrawal described in our Refund Policy and the right to services performed with reasonable care and skill.
9. Liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Otherwise, for business clients our total liability is limited to the fees paid for the service giving rise to the claim, and we are not liable for indirect or consequential loss.
10. Complaints and disputes
Complaints can be sent to contact@lomzyn-studio.online; we respond within 14 days. EU consumers may also use the European Commission's Online Dispute Resolution platform or contact their local consumer authority. UK consumers may contact Citizens Advice.
11. Governing law
These Terms are governed by Polish law. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence and may bring proceedings in your local courts, including in the UK.
12. Changes
We may update these Terms from time to time. The version in force at the time you placed your order applies to that order.
